By accessing or using Fragrance Free Nation ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
Fragrance Free Nation is a fragrance-free product discovery and marketplace platform that helps users find, compare, and purchase products suitable for fragrance sensitivities. Users may browse product information, read community feedback, and purchase products directly from independent sellers through our marketplace. We integrate with various third-party data sources, APIs, and e-commerce partners to display product information and affiliate links. Product listings and integrations may expand to include additional retailers, brands, or data providers over time.
You must be at least 13 years old to create an account. If you are under 18, you must have consent from a parent or legal guardian. If you are located in the European Economic Area (EEA), you must be at least 16 years old or have parental consent.
You must provide accurate, current, and complete information when creating your account, and you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach.
You may make a purchase without creating an account. If you do, we email you a link to your order, which lets you follow it, report a problem or request a return. Anyone who has that link can open the order, so keep it private. These Terms apply to purchases made without an account. You must be at least 18 years old, or have the consent of a parent or legal guardian, to make a purchase.
You agree not to use our services for any unlawful, harmful, or disruptive activity. You may not attempt to hack, scrape, reverse engineer, or interfere with the operation of our systems. The use of automated tools, bots, or scripts to collect or extract data without our written permission is strictly prohibited.
We reserve the right to suspend or terminate any account or access that violates these Terms or harms the platform, other users, or our partners.
By posting content, you grant us a non-exclusive, worldwide license to use, reproduce, and distribute it for service improvement. Feedback and beta testing input may be used to develop our products without compensation.
We integrate with various third-party data providers, APIs, affiliate networks, and e-commerce platforms to display product information. Product details, pricing, availability, and images come directly from those external sources and are provided "as is." Affiliate commissions may be earned from qualifying purchases made through linked products, in accordance with applicable disclosure requirements.
We maintain proper attribution as required by our data partners and comply with their respective API or affiliate program terms. Fragrance Free Nation does not guarantee the accuracy, completeness, or availability of third-party product information and is not responsible for errors, omissions, or delays caused by those external systems.
Brands, vendors, or individual sellers may list their own fragrance-free products directly on our platform. Sellers are subject to the Fragrance Free Nation Seller Program Terms, which govern product standards, commission and fees, order fulfillment, payouts, returns, and seller conduct. By listing products on Fragrance Free Nation, sellers agree to comply with both these Terms of Service and the Seller Program Terms.
Fragrance Free Nation reserves the right to remove, edit, or suspend any listing that violates these terms or misrepresents products.
When you purchase a product through the Fragrance Free Nation marketplace, you are purchasing directly from the independent seller who listed that product. Fragrance Free Nation is a marketplace facilitator and is not the seller of record. We do not take title to, possess, or inspect products sold through the marketplace.
All payments are processed through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service. Fragrance Free Nation does not store your payment card information.
You may cancel an order within twenty-four (24) hours of purchase, provided the order has not yet shipped. Full refunds are issued for eligible cancellations.
Returns are governed by each seller's return policy as it stood when you placed your order. The policy is displayed on the seller's shop page and product pages. All returns and problem reports must be requested within thirty (30) days of delivery. An order is delivered when the carrier or the seller's store reports it delivered. Where the seller ships with its own label and no delivery is reported, the order is treated as delivered ten (10) days after it shipped. If your order has not arrived, you can report it as never arrived from your order page once seven (7) days have passed since it shipped.
Items that are always covered. Whatever a seller's return policy, an item that arrives damaged, is defective, is the wrong item, or never arrives is covered by the seller. A photo is required for a damaged, defective, or wrong item. The seller will refund you, send a replacement, or have the item sent back at the seller's cost. A covered item costs you nothing to return, and the refund includes the sales tax you paid on it and, where every item in your order from that seller is covered, the shipping you paid.
Other returns. Other return requests require seller approval. Return shipping is paid by you or by the seller, as the seller's return policy states. If you choose a prepaid return label, its cost is deducted from your refund. Refunds are issued within five (5) business days of the seller receiving the item.
Review. If a seller does not respond within three (3) business days, Fragrance Free Nation reviews the request. You may also ask Fragrance Free Nation to review a denied return. Refunds are processed through Stripe to your original payment method. Actual refund processing time depends on your financial institution.
Sellers are solely responsible for the quality, safety, accuracy, and legality of their products. Fragrance Free Nation does not manufacture, inspect, or endorse any seller products. You acknowledge that any claims related to product quality, safety, or fulfillment are between you and the seller.
If you have a problem with an order, report it or request a return from your order page. The seller is asked to respond first. Fragrance Free Nation reviews a request in the cases described in Section 8.4 and decides each one on its facts. For any other dispute with a seller, Fragrance Free Nation may mediate at its discretion but is not obligated to do so. Fragrance Free Nation reserves the right to issue refunds in cases of seller non-response, policy violations, or fraud.
Your personal data is collected and used as described in our Privacy Policy. Use of our services constitutes consent to our data practices as described in that Policy. We collect analytics, session replays, and engagement metrics to improve our services. After account termination, data may be anonymized and retained for analytics, audit, and compliance purposes.
All content, software, features, design elements, and other intellectual property on the platform are the exclusive property of Fragrance Free Nation and are protected by applicable intellectual property laws, including copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.
Our services and all content are provided "as is" and may change at any time. We strive for accuracy but do not guarantee that all product data or AI-generated results are error-free. Product information and recommendations are provided for general informational purposes only and do not constitute medical, professional, or product-specific advice. Always consult a qualified professional regarding fragrance sensitivities or medical concerns.
Fragrance Free Nation does not warrant, endorse, or guarantee any products sold by independent sellers through the marketplace. We do not inspect, test, or verify seller products and make no representations regarding their quality, safety, accuracy, or fitness for any particular purpose.
To the fullest extent permitted by law, Fragrance Free Nation and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising out of or related to your use of or inability to use our services.
Fragrance Free Nation is not liable for any damages, losses, or claims arising from products purchased through the marketplace, including but not limited to product defects, allergic reactions, misrepresentation, or fulfillment failures. Such claims are between the buyer and the seller.
Our total aggregate liability shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim. This limitation does not apply to fraud, willful misconduct, or liability that cannot legally be excluded.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in California under the Commercial Arbitration Rules of the American Arbitration Association (AAA).
By using our services, you waive any right to participate in class actions or jury trials, except where such waiver is prohibited by applicable law.
We may suspend or terminate your account at any time if you violate these Terms. Upon termination, your access ends immediately, but anonymized data may be retained for analysis or compliance. If you have pending marketplace orders at the time of termination, those orders will be fulfilled or refunded in accordance with the applicable return and refund policies. Outstanding payouts to sellers will be processed per standard schedules.
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, power or internet failures, system outages, cyberattacks, data loss, third-party service disruptions, or other unforeseen events. In no event shall Fragrance Free Nation be liable for any damages arising from such events or any interruption of service, regardless of cause.
We may update these Terms from time to time to reflect changes in our business or legal requirements. Material updates will be communicated via email, in-app notification, or a prominent notice on our website. Your continued use of our platform after an update constitutes acceptance of the revised Terms.
